California Wage and Hour Employer Defense Lawyer: Liability Review

Практика:Corporate

Автор : Donghoo Sohn, Esq.

A California wage and hour employer defense lawyer assesses alleged violations, supporting records, and potential liability.

The review separates worker classification, pay calculations, and recordkeeping issues under federal and state law. Payroll and actual job duties help test each allegation. Corrective action may affect exposure, but its effect depends on the claim and applicable legal requirements.

Contents

1. Start with the Claim, the Workers, and the Records

A demand letter’s total is a starting point for review. Identify the alleged violations, affected workers, and disputed pay periods before estimating liability. General wage and hour obligations provide context; the defense depends on the requirements and evidence supporting each claim.

Federal and State Standards Require Separate Review

The Fair Labor Standards Act (FLSA) generally requires overtime for covered, nonexempt employees working more than 40 hours per workweek. California law also generally requires daily overtime, subject to exceptions. Meeting the federal weekly threshold does not resolve state overtime, meal-period, or exemption issues.

Determine How Far the Alleged Practice Reached

Check whether the problem arose from one supervisor, a payroll setting, or a shared policy. Compare positions, schedules, and employment dates before applying one employee’s allegations across the workforce. Different practices may require separate calculations.

2. Distinguish Contractor Status from Overtime Exemption

An independent contractor classification and an employee’s overtime exemption involve different legal tests. A defensible employee misclassification analysis identifies the applicable test before assessing whether the records support the employer’s position.

Contractor Agreements Do Not Decide Worker Status

The ABC test generally requires the hiring entity to establish freedom from control, work outside its usual business, and an independently established business. Statutory exceptions may require another test, including Borello. An exception from the ABC test does not automatically establish contractor status, and the agreement must match the actual working relationship.

Review Actual Duties and Compensation

For an employee classified as exempt, examine the particular exemption under both applicable federal and state standards. Job titles and salary alone do not establish the common executive, administrative, or professional exemptions. Compare actual duties and compensation with the requirements governing the disputed period.

3. Compare Payroll Data with What Happened at Work

Time records and payroll exports should tell a consistent story. Compare them with schedules, supervisor messages, correction requests, and payment confirmations. When records conflict, investigate the discrepancy before relying on either version.

Trace Deductions, Edits, and Interruptions

An automatic meal deduction does not establish that an employee received a compliant meal period. Review whether the employee received relief from duties and whether the employer knew or should have known about work performed. Preserve original entries and edit histories before changing system settings.

Keep Historical Records Intact

Preserve payroll records, wage statements, job-duty documents, and employee complaints. Keep later investigative notes separate from contemporaneous evidence. Document missing information and disputed assumptions without rewriting historical records to fit an explanation.

4. Calculate Each Category of Liability Separately

Unpaid wages, damages, statutory penalties, and PAGA civil penalties have different requirements. A useful estimate separates established underpayments from amounts that depend on disputed facts, additional legal elements, or overlapping remedies.

Identify What Each Remedy Requires

CategoryKey Question
Unpaid wages or overtimeWhich hours, rates, exemptions, or payments are disputed?
Waiting-time penaltiesWas final pay late, and was nonpayment willful?
Wage statement reliefWhat information was inaccurate, and what remedy’s requirements apply?
PAGA civil penaltiesWhich violations, workers, and pay periods support the claim?

A genuine good-faith dispute can defeat waiting-time penalties without eliminating wages owed. Merely disputing a claim is insufficient; unsupported or unreasonable defenses do not establish good faith.

Check Scope and Overlap

Do not multiply every alleged violation across the entire workforce without testing the underlying assumptions. Check which remedies may coexist and which limits prevent overlapping recovery. PAGA penalties are distinct from unpaid wages and other employee remedies.

5. Assess What Corrective Action Can Resolve

Fixing a payroll practice can prevent further errors, but its effect on past liability requires separate analysis. A handbook revision does not pay previously omitted wages or automatically resolve pending claims.

Separate Paga Penalty Reduction from Formal Cure

The 2024 PAGA reforms introduced penalty-reduction opportunities and expanded cure procedures, subject to statutory conditions and applicable transition rules. Compliance measures, formal cure, and judicial early evaluation are different routes. Employer size, notice timing, and the alleged violation affect the available options.

Address Past Payments and Remaining Claims

Depending on the violation, cure may require corrected wage statements, payments owed, interest, applicable liquidated damages, and reasonable attorney’s fees and costs. Resolving a PAGA issue does not automatically settle separate claims.

When allegations involve multiple workers or overlapping remedies, employment defense litigation counsel can review response obligations and corrective options. The notice, original payroll data, classification records, and a dated account of corrective measures provide a practical starting point.
